Thoughts on the Legality and Veracity of the Proto Criteria

 

Every Nation upon the face of the Earth has an origin.  Western European Monarchies often trace their origin back to the anointing of their first King or Emperor.  The tradition of anointing their Kings came from their Christian faith, they followed the protocol they read about in the Scriptures.

Consider this Biblical account of the anointing of King David:

“The Lord said to Samuel, “How long will you mourn for Saul, since I have rejected him as king over Israel? Fill your horn with oil and be on your way; I am sending you to Jesse of Bethlehem. I have chosen one of his sons to be king.”

 But Samuel said, “How can I go? If Saul hears about it, he will kill me.”

 The Lord said, “Take a heifer with you and say, ‘I have come to sacrifice to the Lord.’ Invite Jesse to the sacrifice, and I will show you what to do. You are to anoint for me the one I indicate.” – 1 Samuel 16:1-3 NIV

“Jesse had seven of his sons pass before Samuel, but Samuel said to him, “The Lord has not chosen these.” 

 So he asked Jesse, “Are these all the sons you have?”

 “There is still the youngest,” Jesse answered. “He is tending the sheep.” Samuel said, “Send for him; we will not sit down until he arrives.”

 So he sent for him and had him brought in. He was glowing with health and had a fine appearance and handsome features.

 Then the Lord said, “Rise and anoint him; this is the one.”

 So Samuel took the horn of oil and anointed him in the presence of his brothers, and from that day on the Spirit of the Lord came powerfully upon David. Samuel then went to Ramah.” – 1 Samuel 16:10-13 NIV

The point of all this is to demonstrate that the Oil of Anointing is a Token of Validation, that whoever or whatever was Anointed was Justified and Legitimatized.  A Monarch has a rightful claim to their Authority and their Throne because they were Anointed.  But there is a caveat – a Monarch cannot Anoint themselves, they must be Anointed by someone else.  Therefore, whoever or whatever has the Power to Anoint has the power to create a King.

With this in mind, we can discuss how this concept might be applied to origin of the United States.

When our country broke from Great Britain, we needed to Justify that break in no uncertain terms.  We needed something to Validate our Claim.

On July 4, 1776, Representatives of the newly formed United States of America issued a Formal Declaration to the World-at-Large announcing their Independence from the Authority of the King of England.

To justify their Actions they submitted the following paragraph written by Thomas Jefferson:

“We hold these Truths to be self-evident, that all Men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty, and the pursuit of Happiness—-That to secure these Rights, Governments are instituted among Men, deriving their just Powers from the Consent of the Governed, that whenever any Form of Government becomes destructive of these Ends, it is the Right of the People to alter or abolish it, and to institute a new Government, laying its Foundation on such Principles, and organizing its Powers in such Form, as to them shall seem most likely to effect their Safety and Happiness.” – U.S. Declaration of Independence

The Proto Criteria are the Three Unalienable Rights identified by Thomas Jefferson in the U. S. Declaration of Independence.  They are the Fundamental Elements required to legitimately establish any form of Government upon the face of the Earth.  As Jefferson indicated, it is to secure these Rights [that] Governments are instituted among Men.  Without an acknowledgment of the Proto Criteria, no Government has the right or reason to exist – and it is the People who have the right to alter or abolish it, and to institute a new Government, laying its Foundation on such Principles.

In other words, the Proto Criteria are the Sacred Oil by which the Sovereignty of the United States’ Government was Anointed – and they are bestowed upon us by our Creator.

If the Proto Criteria had not been violated, we would have not been justified in breaking with the King of England, for Governments have no legitimate reason to exist save to Secure the Proto Criteria.

Therefore, every Branch of the U.S. Government owes its very existence to the Proto Criteria.  Every Officer and every Elected Official derives their Legitimacy and their Authority from a pledge to Secure the Proto Criteria.  Without the aspiration to Secure and Restore the Proto Criteria the United States had no right to establish itself as a separate nation apart from the United Kingdom.

This means the Question as to whether or not the Proto Criteria are Legally Binding is purely academic.  The Proto Criteria are not a product of the Law, they are the origin of the Law, and therefore do not require a law to become binding.  First come the Proto Criteria, whose violation justified the creation of our Nation, then comes the Law. It is the Law that must be qualified by the Proto Criteria, not the Proto Criteria that needs to be qualified by the Law.  The Law is invalid if it reaches beyond the constraints of the Proto Criteria.
